Retrostalgic (“Company”, “we” or “Retrostalgic”) has adopted this Privacy Policy to explain how Retrostalgic collects, stores, and uses the information collected in connection with Retrostalgic’s mobile applications, services, and websites (collectively, “Services”).  Retrostalgic respects the privacy of the users of their Services (“User” or “you”) and is committed to protecting the User’s information. You have a right to know our practices regarding the information we may collect and use when you use our Services.

Retrostalgic operates certain mobile applications which may be viewed as being directed to children under the age of thirteen (13), including without limitation the  following mobile applications: Fish Food Frenzy Fun, Aerolite, Soccer Kickoff, Cowabunga, Erase Car (collectively, “Kids Apps”), as well as mobile applications which are not directed to children under the age of thirteen (13) ("General Apps"). (“Kids Apps” and “General Apps” shall collectively be referred to as “Apps”). Retrostalgic’s privacy practices and principles that pertain to Kids Apps are described in chapter A below, our Kids’ Privacy Policy. Retrostalgic’s privacy practices and principles that pertain to General Apps are described in Section B below.

Note that the “Kids Privacy Policy” (Section A), the “General Apps Privacy Policy” (Section B), and the “Privacy Policy for Website Visitors and Mailing Lists” (Section C), which are each set forth below, are referred to collectively herein as “this Privacy Policy”.

Retrostalgic reserves the right to modify this Privacy Policy as reasonably necessary, so please review it frequently.  Your continued use of the Services will signify your acceptance of the changes to this Privacy Policy.  


Section A: Kids Privacy Policy

PLEASE NOTE: IF YOU OR, AS APPLICABLE, YOUR LEGAL GUARDIAN, DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT INSTALL, ACCESS AND/OR USE THE KIDS APPS AND YOU ARE REQUESTED TO PROMPTLY ERASE THEM, AND ANY PART THEREOF, FROM YOUR MOBILE DEVICE.

If you are under 13 years of age or a minor in your country of residence, please ask your legal guardian for permission to access the Kids Apps after your legal guardian reviews this Privacy Policy. Retrostalgic encourages parents and/or guardians to play an active role in their children’s online experience. This Kids Privacy Policy is designated to provide the legal guardian of a child under the age of 13 years old, with guidance regarding our privacy policies and principles with respect to collecting, using and disclosing personal information regarding children under the age of 13 (“Kids”) when using our Kids Apps.

1. Personal Information

While the Kids Apps are being used by our Users, other than as expressly specified in Section A. 3.2 (Advertising Identifiers), and Section C (Website Visitors) below, we do not knowingly collect Personal Information from Kids and hereby specifically prohibit any User under the age of 13 from providing Retrostalgic with any Personal Information. If you are a legal guardian of a child under the age of 13 and you believe that your child has provided Retrostalgic Personal Information, please contact us at info@retrostalgic.com and we will delete such information from our servers.  

For purposes of this Privacy Policy, “Personal Information” includes without limitation the following:

Retrostalgic does not directly collect and store on its servers any Personal Information from Users of the Kids Apps. Further, Retrostalgic has taken commercially reasonable steps to ensure that third party providers of certain products and services, such as advertising networks, web analytics services, distributors, and game centers, etc. (“Third Parties”), fully comply with the terms of this Kids Privacy Policy.  But Retrostalgic does not have access to or control of the Third Parties’ technologies.  Any question about Third Parties’ privacy practices and policies should be directed to such Third Party (as further identified in this Privacy Policy).

2. Offline Use

For certain Kids Apps, Retrostalgic allows an offline use (i.e., without Internet connection). Offline use of Kids Apps will preclude the collection by Retrostalgic and/or Third Parties of any information pertaining to you, as the legal guardian of a Kid, and/or your use (including, as applicable, information pertaining to your Kid and his/her use) of the Kids Apps.

3. Online Use

There are three types of data and information which may be collected from Users during online use of our Kids Apps:

3.1 Non-personal Data

Retrostalgic allows Third Parties to collect non-identifiable and anonymous information as detailed below (“Kids Non-personal Data”).

With respect to such Kids’ Non-personal Data, Retrostalgic and the Third Parties have no idea of the identity of the User from whom Third Parties have collected the Kids Non-personal Data. Kids Non-personal Data collected by Third Parties may include the following technical information: type of operation system (e.g. Android, iOS, etc.), type of browser (e.g. Edge, Explorer, Firefox, Chrome, Safari, etc.), screen resolution (e.g. 800×600, 1024×768, etc.), language (e.g. English), device type (e.g. Galaxy, HTC, iPhone, etc.), geo-location – only general location may be collected. No street name or city/town name is collected.

Any Third Parties’ collection of Non-personal Data is for strict and limited purposes. Namely, for the limited purpose of analyzing the Kids Apps in order to provide the Users of Kids Apps with the Kids Apps’ functionalities and performance.

3.2  Advertising Identifiers

For mobile applications accessed through the Google and iOS platforms, the Kids Apps may provide access to the User’s anonymous advertising identifier (i.e., respectively, the AAID for Google, and the IDFA for iOS) in accordance with the applicable platform provider’s policies.

For mobile applications accessed through platforms outside of Google and iOS, the Kids Apps may provide access to other advertising identifiers as applicable or available.  

Retrostalgic does not directly access or utilize any User’s advertising identifier. Retrostalgic allows the User’s anonymous advertising identifier to be collected for serving Users of Kids Apps with advertisements as permitted under applicable laws and rules, including serving Users of the Kids Apps with only “contextual advertisements”, i.e., advertisements served without connection to the User’s online behavior.

3.3  How User Information is Collected

The above-mentioned Non-personal Data and the User’s advertising identifiers are collected by Third Parties through the Kids Apps, including, without limitation, through such Third Parties’ SDK embedded in our Kids Apps. In addition, Kids Non-personal Data and advertising identifiers may also be stored on the Users’ device via generally accepted industry technologies used within the Kids Apps, such as “cookies” and local storage.

4. Advertising

In our free Kids Apps, we may accept and display advertisements from Third Party ad networks. Retrostalgic makes commercially reasonable efforts to ensure that the Third Party ad networks comply with applicable privacy laws, and we reasonably believe each of these ad networks are compliant with the Children’s Online Privacy Protection Act of 1998 and the rules promulgated by the Federal Trade Commission (FTC) under that Act, including but not limited to the Children’s Online Privacy Protection Rule, 16 C.F.R. Part 312, in performance of their services towards Retrostalgic. Note that if the User of the Kids Apps clicks on any advertisements through the Services, the advertisers may use cookies and other web-tracking technologies to collect Kids Non-personal Data and/or Kids personally identifiable information. We recommend that you, as the legal guardian of a Kid, review the terms of use and privacy policy for any advertiser with whom you and/or the User of the Kids Apps are interacting before doing so. Their privacy policy, not ours, will apply to any of those interactions. The Third Party ad networks which may display advertisements in our Kids Apps are as follows:

In addition, Retrostalgic may, at its discretion, advertise other Retrostalgic Apps within the Kids Apps. Such advertisements are not directed towards specific Users but are rather broadly posted onto random Retrostalgic Apps.

5. Using Game Center Features

Our Kids Apps may permit use of certain game center features. The game center features are operated or allow for social integration with certain third party platforms ("Platform").

These Platforms are created and maintained by third parties who are not affiliated with and/or controlled by Retrostalgic. Your use of the game center features is subject to the applicable third party Platform’s terms of use and privacy policies, as identified below.

You should ensure that you read their terms of use and privacy policies to understand how they treat your information and in order to understand the methods for changing the privacy or sharing settings on such services. If you do not agree to the practices described in such terms you should not use the Kids Apps.


Section B: General Apps Privacy Policy

1. Personal Disclosure

This General Apps Privacy Policy is designated to provide you guidance regarding Retrostalgic’s privacy policies and principles with respect to collecting, using and disclosing personal information regarding Users who are using our General Apps.

There are two types of data and information which may be collected from Users of our General Apps:

1.1 Non-Personal Data

The first type of information is non-identifiable and anonymous information. This Non-personal Data may be collected, stored and/or processed by us and/or our third party providers of certain products and services, such as advertising networks, web analytics, etc. (“Third Party(ies)”). Retrostalgic and Third Parties are not aware of the identity of the User from whom Non-personal Data has been collected. Non-personal Data is any information which is available to Retrostalgic and/or Third Parties through use by Users of the General Apps. Non-personal Data which may be collected may include, for example, aggregate data, technical information, statistical information and behavioral information, and may contain, among other things, device type, type and version of operating system, network provider, browser identifiers, type of browser, screen resolution, session information, SDK version, API key, time spent playing, browser cookies, levels achieved, application version, in-app purchases, network status, local and time zone, clicks on advertisements Third Parties display on the General Apps, certain information about the advertisements reviewed by the User, the activities of the User in the General Apps (including without limitation any information relating to the User's activity in connection with the advertising displayed therein), what tools in the General Apps the User uses, etc.

1.2 Personal Information

The second type of information is individually identifiable information (“Personal Information”). This information may identify an individual and/or may be of a private and/or sensitive nature. Third Parties, through the General Apps or in connection with the purchase or distribution of the General Apps, may collect, without limitation, the following Personal Information:

  1. The User’s personal identifiers (such as, the User’s anonymous advertising identifier (when available on a device) device identifiers, for example the IP address, carrier user ID, Unique Device Identifier (UDID), and/or Media Access Control (MAC) address). We note that Retrostalgic may collect, use and provide access to the User's advertising identifier in accordance with the applicable platform provider's policies.

  2. Third Party stores and websites through which the General Apps are sold and/or distributed (“Third Party Stores”) may collect Personal Information from Users, including the User’s email address and financial information the Third Party needs to process your charges. Retrostalgic does not receive or request financial information obtained by Third Parties in connection with the sale or distribution of the General Apps, but may receive other Personal Information collected by Third Parties during the sale and/or distribution of the General Apps. If Retrostalgic receives any Personal Information collected by Third Parties during the sale and/or distribution of the General Apps we will only use this information if necessary to support or provide access to the purchased products and/or services.

  3. Third Parties may also track and collect information regarding your online activities over time and across different online platforms (such as, websites, applications, etc.). For more information regarding your ability to cease such tracking and collection, please review the Third Party privacy policies identified in Paragraph 5 below.  For avoidance of doubt, any Non-personal Data connected or linked to or associated with any Personal Information shall be deemed as Personal Information as long as such connection, linkage or association exists.

  4. We collect information you provide directly to us, such as when you participate in a contest and promotion, communicate with us via third party social media sites, request customer support, send us an email or otherwise interact with us. The types of information we may collect about you include your name, social networking screen names or IDs, email address and any other information you choose to provide.

2.   How User Information is Collected

2.1  Collection of Non-Personal Data

Non-personal Data may be collected through your use of the General Apps. In other words, when you are using the General App Retrostalgic and Third Parties are aware of it and may gather and collect, including without limitation, through such Third Parties’ SDK embedded in our General Apps, the information relating to such usage. In addition, local Non-personal Data may also be stored on your device via generally accepted industry technologies used within the General Apps, such as “cookies” and local storage.

2.2   Collection of Personal Information

Third Party Stores, including without limitation Steam, Humble Bundle and itch.io, may collect Personal Information from Users, including financial information the Third Party Store utilizes to process your charges. Users who purchase a General App through a Third Party Store should consult the Third Party Store’s privacy policy for further details concerning the collection, use and/or sharing of the User’s financial information or other Personal Information:

Additionally, Retrostalgic may collect Personal Information through direct interaction, communication, or social media, including without limitations, leaderboards and mailing lists.

4.  Sharing Information with Third Parties

To operate the Services, we also may make Non-Personal Data and Personal Information available to third parties under the following circumstances:

(1) with your express consent;

(2) when we have a good faith belief it is required by law;

(3) when we have a good faith belief it is necessary to protect our rights or property; or

(4) to any successor or purchaser in a merger, acquisition, liquidation, dissolution or sale of assets.

Your consent will not be required for disclosure in the foregoing circumstances, but we will attempt to notify you, to the extent permitted by law to do so. Retrostalgic may transfer and disclose Non-personal Data to third parties at its discretion.

5.  Advertisements

In our free General Apps, we may accept and display advertisements, in various formats (such as banners, interstitials, rewarded videos, etc.) from Third Party ad networks. Note that if you click on any of these advertisements, the advertisers may use cookies and other web-tracking technologies (such as tracking pixel agent or visitor identification technology, etc.) to collect data regarding advertisement performance, your interaction with such ads and our General Apps and your interests (which may include, non-personal and/or personal information (such as, device and network information, unique identifiers, gender, age and geo-location) about you) in order to serve you advertisements and for the legitimate business interests of such Third Parties ad networks. We recommend that you review the terms of use and privacy policy of any third party advertisers with whom you are interacting before doing so. Their privacy policy, not ours, will apply to any of those interactions. The Third Party ad networks which may display advertisements in our General Apps are as follows:

In addition, Retrostalgic may, at its discretion, advertise other Retrostalgic Apps within the General Apps. Such advertisements are not directed towards specific Users but are rather broadly posted onto random Retrostalgic Apps.

6.  Using Game Center Features and Social Features

Our General Apps may enable using certain game center features and may include social features. The game center and social features are operated on third party application platforms (“Platforms”) or allow for social integration with certain third party social networks (“Social Networks”). The Platforms and Social Networks, such as Steam, Amazon Game Circle, Apple Game Center, and Google Play Game Services, are open communities where you should expect that your gameplay information including without limitation your user name, social media profile picture, game activity/statistics, multiplayer match information (including player-to-player communications), and leaderboard rankings are publicly posted and shared within the General Apps, on the Platform or Social Networks, and/or third-party games or web pages.

Retrostalgic does not collect or share information that we know directly and clearly identifies you (such as your real name or email address). The Platforms and Social Networks, however, are created and maintained by third parties who are not affiliated with and/or controlled by Retrostalgic. Your use of game center and/or social features is subject to the applicable third party Social Network’s or Platform’s terms of use and privacy policies, as identified below.

You should ensure that you read their terms of use and privacy policies to understand how they treat your information and in order to understand the methods for changing the privacy or sharing settings on such services. If you do not agree to the practices described in such terms you should not allow our General Apps to interact with such Social Networks or Platforms, however you may find that you are not able to enjoy all the features that may be made available by our General Apps. You understand that where you allow interaction with any third party Social Network or Platform, you may share data with your contacts (and vice versa) in order that you may enjoy social elements in connection with your use of the General Apps.

By using any social and/or game center features you hereby agree and understand that the applicable Social Networks or Platforms may collect certain Personal Information, such as your IP address, Non-personal Data and may set cookies and/or other web tracking technologies to enable the functionality of the social and/or game center features. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the third party that provides the social and/or game center features. You hereby understand and agree that when you share content via Social Networks or Platforms that your content may become public and any person may re-post-it.

7. User Generated Modifications

Certain General Apps available on Steam allow you and other users to develop, upload and distribute user generated modifications to the General Apps (“User Mods”), via the Steam Workshop. Your use of the Steam Workshop and/or creation of User Mods is subject to the applicable Steam terms of use, as set forth in the Steam Subscriber Agreement, which can be found at the following link: http://store.steampowered.com/subscriber_agreement

When you upload or submit User Mods to General Apps, you convey to Retrostalgic the right for Retrostalgic and its affiliates to communicate, distribute, host, publicly display, market, reproduce, store and use the User Mods. Retrostalgic may modify, prevent access to, delete, or refuse to display User Mods that we believe violate the law or which are uploaded for any purpose not reasonably intended for the General Apps (within Retrostalgic’s independent discretion). However, Retrostalgic has no obligation to monitor or review any User Mods uploaded or submitted to the General Apps. By uploading or submitting User Mods to any General Apps, you are assuming all risk of liability from any legal violation or claim for damages arising from the User Mods. Retrostalgic is not responsible for the content of any User Mods and denies all liability associated with the User Mods. Your use of User Mods through any General Apps is at your own risk.


Section C: Privacy Policy for Website Visitors

Websites: Visitors to websites operated by Retrostalgic, including without limitation retrostalgic.com, sneeziesgame.com, and monstersandmonocles.com (collectively, the “Sites”), choose to interact with  the Sites ways that result in Retrostalgic collecting Personal Information. The amount and type of information gathered depends on the nature of the interaction. In each case, the Sites collect such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with the Sites.

Log file information is automatically reported by your browser each time a User accesses a web page on any of the Sites, including access through the Apps or any other Service (for example, when a user clicks the “more games” link from an App or Site).  When you access a Site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP”) address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information. We do not link this automatically-collected data to any User’s personally identifiable information.

Retrostalgic may utilize this data to monitor the Sites’ performance, to optimize the content of the Sites, and to detect malfunctions or malicious behavior. Retrostalgic will not share its detailed log files with any third parties, unless we are required to transfer such data by law. This does not include our website hosting partners, who receive data from the Sites solely to assist Retrostalgic in the operation of the Sites.

Individual pages on the Sites may contain links to images on other web sites. If your web browser is configured to fetch images automatically, similar data may be recorded by these other web servers as well as the images are being loaded.

We may use cookies, web beacons, and other similar technologies to collect information about visitors of the Sites. Cookies are small bits of information that are stored by a computer’s web browser. Web beacons are very small images or small pieces of data embedded in images, also known as "pixel tags", "GIFs", or "clear GIFs", that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from a computer or device. We use these technologies, for example, to help us recognize your browser as a previous visitor.

We may allow Third Parties to place and read their own cookies, web beacons, and similar technologies to collect information or provide services through the Sites. For example, Google Analytics and other third-party analytic companies may access anonymous data (such as your IP address or device ID) to help Retrostalgic understand how our Services are used. Such third-parties use this data solely on our behalf. They do not share it except in aggregate form; no data is shared as to any individual User. Please review Google Analytics’ Privacy Policy for further information concerning its relevant data collection and privacy practices.

In addition, the Sites may also contain widgets hosted by Third Parties. Widgets allow you to view and interact with content hosted on external websites or platforms directly from the pages of the Sites.These widgets may collect certain Personal Information from visitors to the Sites, including without limitation log file information, cookies, web beacons, and/or similar technologies. If you purchase a General App or any other product or service through a widget on the Site, the Third Party hosting the widget may collect your financial information in connection with such purchase. Your interactions with any widgets on the Sites are governed by the privacy policy of the Third Party hosting the widget.

You may be able to refuse or disable cookies by adjusting your web browser settings. Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section). Please note that you may need to take additional steps to refuse or disable cookies, web beacons, and similar technologies. If you choose to refuse, disable, or delete these technologies, some of the functionality of our site may no longer be available to you.
